Governed by the IT Act 2000, DPDP Act 2023, and Indian Contract Act 1872
This document constitutes an electronic record under the Information Technology Act, 2000. By accessing the platform or booking a service, the User enters into a legally binding contract with OneDayPA.in. Use of our services constitutes irrevocable acceptance of these terms in their entirety.
OneDayPA operates as a specialized proxy facilitation platform where assistants function as physical surrogates for the Client. We do not provide licensed professional services such as legal, medical, or financial consultancy; we merely execute administrative or manual tasks provided by the Client as a surrogate presence.
Pursuant to Section 11 of the Indian Contract Act, 1872, the user must be at least 18 years of age and legally competent to contract. Any service requested for a minor must be booked by a legal guardian who assumes full responsibility for the assistant's interactions and the safety of the minor involved.
OneDayPA reserves the absolute right to refuse any task involving contraband, illegal substances, or items prohibited under the NDPS Act, 1985. Any attempt to utilize our services for criminal activity will result in immediate termination of the session and reporting to the relevant law enforcement authorities.
For all tasks involving Banking, RTO, or Property visits, the Client is legally mandated to provide a signed LoA. Our assistants will never "impersonate" a client; they will always present themselves as authorized proxies to maintain the highest level of transparency and avoid fraud allegations.
The safety and dignity of our assistants are paramount. OneDayPA reserves the right to withdraw an assistant from a site immediately if the environment is found to be hostile, hazardous, or unprofessional. In such cases, the full service fee remains payable to compensate the assistant for their time.
In compliance with GST and income tax laws, all third-party payments (stamp duty, Gov challans, etc.) are handled as "Pure Agent" reimbursements. OneDayPA does not charge a commission on these actual costs. Clients must provide these funds in advance or reimburse them immediately against digital receipts.
Pursuant to Section 73 of the Indian Contract Act, our liability for any claim arising out of a service failure is strictly limited to the amount of the service fee paid. We are not liable for any indirect, incidental, or "consequential" losses, such as missed business opportunities or emotional distress.
The Client agrees to indemnify and hold OneDayPA harmless from any legal action resulting from the Client providing inaccurate information or fraudulent documents. This includes disputes arising from property access where the Client's authority is legally contested by family members or third parties.
Clients are strictly prohibited from hiring OneDayPA assistants directly or bypassing the platform for a period of 12 months post-service. Violation of this clause shall attract a liquidated damage fee of INR 50,000, acknowledging the cost of recruitment, vetting, and training invested by the company.
Service quotes include a fixed duration of on-ground assistance. If an assistant is kept waiting beyond the included hours due to hospital delays or government queues, a "Waiting Surcharge" will be billed to the Client. This ensures fair compensation for the assistant's extended time.
A 100% refund is applicable if cancelled 24 hours prior to the slot. If cancelled within 2–12 hours, a 50% convenience fee is deducted to cover assistant scheduling. No refunds are provided once the assistant has departed for the location or reached the site.
We are not liable for failures caused by events beyond our control, including "Acts of God" (Mumbai floods), strikes, or sudden government holidays. Under Section 56 of the Contract Act, the contract may be suspended or frustrated during such events without penalty.
OneDayPA acts as a courier but is not a "Bailee" in the strict legal sense. Our responsibility ends the moment a document is submitted to a government counter or delivered to the designated recipient. We are not liable for losses once the paper leaves our assistant's physical possession.
When assistants supervise external technicians (plumbers, etc.), we act only as your "Eyes on the Ground." Any technical damage or faulty repair by the technician is their sole liability, and the Client must pursue that third-party vendor directly for any damages or refunds.
In hospital escort services, our assistants provide companionship and logistics only. They are legally barred from signing medical consent forms for surgeries or risky procedures; such consent must be provided by the Client or a relative via digital means or a physically present family member.
For driving services, the Client must ensure the vehicle has valid Insurance and PUC certificates. OneDayPA is not liable for mechanical failures, engine damage, or traffic fines resulting from the vehicle's pre-existing conditions or expired documentation provided by the owner.
All content, branding, the "Human API" concept, and software code are protected under the Copyright Act, 1957. No part of our platform or operational manual may be copied or used for competing commercial purposes without explicit written consent.
If any provision of these Terms is found to be unenforceable or invalid by a court of law, that specific provision shall be severed. This will not affect the validity or enforceability of the remaining clauses, which shall continue to be in full force and effect.
Any legal disputes arising from this agreement shall first be attempted to be resolved through amicable mediation. If unresolved, they shall be subject to the exclusive jurisdiction of the Courts located in Mumbai, Maharashtra, and governed by Indian Law.
Under the DPDP Act, 2023, OneDayPA is the "Data Fiduciary." We are legally responsible for determining the purpose of processing your data and ensuring that every byte of information is handled with the highest standard of technical and legal care.
We process your personal data based on your "Explicit and Informed Consent." By clicking "Book Now," you provide us with a clear mandate to use your name, address, and contact details solely for the successful fulfillment of your requested service.
Tasks like elderly care or banking require "Sensitive Personal Data" (SPD). We process SPD with additional layers of encryption and never store such data longer than is strictly necessary for the task's completion, ensuring your medical or financial history remains private.
Your data is used exclusively for the purpose it was collected. If you provide an address for a property check, we will not use that information for marketing, nor will we share it with third parties who are not involved in the direct execution of that specific task.
In compliance with Section 12 of the DPDP Act, you have the right to request the erasure of your data. Once a task is complete, you can ask us to purge your medical or financial documents from our active database to ensure long-term data security.
To protect your interests from foreign surveillance, all personal data of Indian residents is stored on secure cloud servers located physically within India. We do not transfer your sensitive personal information across international borders without explicit legal authorization or necessity.
We follow a strict "Need-to-Know" policy. We will never ask for your Aadhaar number or bank details unless the specific task (like a bank visit or government filing) legally requires that information for us to act as your authorized representative.
Every OneDayPA assistant signs a legally binding Non-Disclosure Agreement (NDA) before being granted access to client details. They are trained to handle client privacy with extreme sensitivity and are prohibited from taking photos of private documents without explicit client permission.
All data transmitted between your device and our servers is secured using TLS 1.2/1.3 encryption. At rest, your sensitive documents are stored using AES-256 bit encryption, making them inaccessible to unauthorized parties even in the event of a system-level breach.
We retain your service logs for a period of 180 days to manage potential service disputes or government audit requirements. After this period, any sensitive documents uploaded for the task are permanently deleted or anonymized to prevent any future identification of the user.
We partner with PCI-DSS compliant payment gateways like Razorpay or Paytm. OneDayPA never stores your full Credit Card or Debit Card numbers on our internal servers; we only receive a secure "token" to confirm the success of the transaction.
We have a strict zero-tolerance policy for selling or trading user data. Your phone number and email address are never shared with insurance companies, telemarketers, or any third-party aggregators for promotional gain, ensuring a spam-free experience for our clients.
Under CERT-In guidelines, we are committed to transparency. In the unlikely event of a data security incident, we will notify the relevant government authorities and all affected users within 72 hours of discovering the breach, providing full mitigation details.
You have the absolute right to access, correct, or update your personal information in our records. If you change your address or phone number, you can update your profile to ensure that future service deliveries are accurate and secure for your family.
We do not knowingly collect data from children under 18 without verifiable parental consent. If a task involves a minor (e.g., school run), all data collection and communication must be handled exclusively through the parent or legal guardian's registered account.
Our website uses "Session Cookies" to keep you logged in and improve site performance. We do not use intrusive "Tracking Cookies" or "Third-Party Pixels" to follow your browsing habits across other websites or social media platforms for targeted ads.
Access to client data by our internal administrators is strictly restricted. Every time a staff member views a client's task details, an "Audit Log" is created, which is reviewed periodically to ensure there is no unauthorized or unnecessary access to private info.
We will only disclose your data to government agencies when presented with a valid legal warrant or order under the CrPC or IT Act. We will always attempt to notify you of such requests unless we are legally barred from doing so.
If we make a significant change to how we handle your data, we will notify you via a "Material Change" email. Continued use of the service after such a notification constitutes your informed consent to the updated and improved privacy practices.
Pursuant to the IT (Intermediary Guidelines) Rules, we have appointed a Nodal Officer. Any privacy concerns or data requests should be emailed to grievance@onedaypa.in, and we commit to a full resolution within 30 business days.
